Terms Of Use

These terms of use (“Terms”) govern your access to and use of the infinityhomes.ae website and any related products and services (together, the “Services”). They form an agreement between you (“User”, “you” or “your”) and Infinity Homes International FZ-LLC (doing business as “Infinity Homes”, “we”, “us” or “our”), a free zone limited liability company licensed by the Ras Al Khaimah Economic Zone (RAKEZ) under Services Licence number 47037574, with its registered office at B4709B2A, Business Center 04, RAKEZ Business Zones, Al Nakheel Area, Ras Al Khaimah, United Arab Emirates.

The public website may be browsed subject to applicable law and these published conditions. Where acceptance is legally required for contractual terms, including restricted account services, we will request appropriate acceptance. Simply reading this page does not constitute consent to the processing of personal data or optional cookies.

Who may use the Services

You must be at least 18 years old to use the Services. If you use the Services on behalf of a company or other legal entity, you confirm that you are authorised to bind that entity, and “you” then refers to that entity as well as to yourself.

What the Services are, and what they are not

The Services provide information on properties in locations where we are authorised to market them, and information about our consultancy and other licensed activities. In relation to certain Dubai developments, our role is limited to introducing interested persons directly to the developer; we do not independently advertise Dubai property listings. The public website is primarily a means of providing information and contacting us.

Published property information and illustrative calculations are not themselves a binding offer, contract, valuation, investment advice or guarantee. Descriptions, measurements, images, prices, availability, indicative currency conversions and projected returns should be checked against reliable transaction documents. See the separate Disclaimer.

Submitting an enquiry does not by itself create a brokerage, agency or advisory relationship with us. Any such engagement is governed by a separate agreement. For a Dubai developer introduction, we disclose the proposed recipient and share the contact details only after your explicit permission; the developer then manages its own sales process.

Accounts and access

Some restricted functions are intended for invited users, including property owners, staff and agents. The owner portal is currently under development and has not been opened to customers. Once available, access will be issued by invitation, not public self-registration, and the Owner Portal Terms will apply.

If you hold an account:

  • you are responsible for everything done through it;
  • you must keep your password confidential and must not share your account or your credentials with anyone, including family members and advisers;
  • you must tell us without delay, at info@infinityhomes.ae, if you believe your account has been used without your authorisation; and
  • you must not attempt to reach data belonging to any other account.

We may suspend or withdraw access to an account at any time, in particular where these Terms have been breached or where an account appears to have been compromised.

Use of the owner portal is additionally governed by the owner portal terms.

Acceptable use

You may use the Services to look at properties, to inform yourself about what we offer, and to contact us about matters we deal with. You must not:

  • copy, extract, index or re-publish our property listings, descriptions, images or data, whether by hand or by any automated means, including crawlers, scrapers and bulk downloaders, except for the limited personal use described below;
  • use contact details obtained from the Services to send unsolicited commercial communications to us, to our staff or to anyone else;
  • submit false, misleading or third-party contact details, or submit enquiries you have no genuine interest in;
  • attempt to gain access to any part of the Services, any account or any data you are not authorised to reach, or probe, scan or test the security of the Services;
  • interfere with the operation of the Services, including by placing an unreasonable load on them or by circumventing rate limits or other protective measures;
  • upload anything containing malicious code, or anything unlawful, defamatory or infringing; or
  • use the Services in breach of any law applicable to you or to us.

Our content

The Services and their content — including text, property descriptions, photographs, floor plans, visualisations, the Infinity Homes name, the tagline “A Better Way of Living”, our logo, and the design and software of the Services — are owned by us or by our licensors and are protected by intellectual property law. Nothing in these Terms transfers any of those rights to you.

Images on the Services may carry a watermark. You must not remove, obscure or alter it.

What you may do. You may view the Services, and you may download, print and forward material we have made available for that purpose — such as a property brochure — for your own assessment of a property, including to share it with your bank, your adviser or your family. You must keep such material unaltered and complete, and must not use it commercially or publish it.

Third-party names, logos and materials appearing on the Services, including those of developers, remain the property of their owners and are used with permission or as a reference.

What you send or upload

You remain the owner of the information, documents and images you send or upload. You grant us only the permission we need to provide the Services to you: to store, process, display and transmit that material for the purpose for which you provided it, and to keep it for as long as described in our privacy policy. We do not use it for advertising, we do not publish it, and we do not pass it to third parties except as described in that policy.

You confirm that you are entitled to provide the material you send us, and that doing so does not infringe anyone’s rights.

Links and third-party services

The Services may link to websites and services we do not operate, including developers’ websites, map services and messaging services. We do not control them and are not responsible for their content, their availability or their handling of your data. Their own terms and privacy policies apply when you use them.

Availability and changes

We aim to keep the Services available, but we do not promise that they will be uninterrupted or free of error. We may change, suspend or discontinue any part of the Services, including individual listings and features, at any time and without notice. Maintenance may make the Services temporarily unavailable.

Liability

We take reasonable care when publishing information and operating the Services, but information may change and online functions may be interrupted. Property information, estimates and third-party material are subject to the qualifications in our Disclaimer. Nothing in these Terms excludes or restricts liability for our own conduct or obligations where applicable law prohibits that limitation, or reduces rights and remedies that cannot lawfully be waived.

Nothing in these Terms limits our liability where that liability cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation. If you are a consumer, these Terms do not affect your statutory rights.

Indemnity

To the extent permitted by applicable law, you may be responsible for reasonable, substantiated losses caused by your unlawful use of the Services, intentional misuse of another person’s rights or material you submit without authority. This provision does not impose liability contrary to mandatory law.

Privacy

Our Privacy Policy and Cookie Policy explain how personal data and cookies are handled. They are separate information notices and do not themselves create consent by being referenced here.

We currently respond individually to enquiries rather than sending newsletters or unsolicited property campaigns. Website advertising measurement using Google Analytics, Google Ads and Meta Pixel is explained in the Privacy Policy and Cookie Policy and is subject to the relevant consent choices.

Ending your use of the Services

You may stop using the Services at any time. We may restrict or end your access to the Services, with or without notice, where you breach these Terms or where we reasonably consider it necessary to protect the Services, our data or other users. Provisions that by their nature should survive — including those on our content, liability, indemnity and governing law — continue to apply after access ends.

General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a reorganisation or a transfer of our business.

These Terms concern use of the website and related digital functions. Separate signed brokerage, consultancy or other service agreements govern the services agreed under them. The Privacy Policy and Cookie Policy are information notices; the Disclaimer explains limitations and qualifications of website information.

Governing law

These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Ras Al Khaimah. Subject to any applicable mandatory jurisdiction rules, the competent courts of Ras Al Khaimah shall have jurisdiction. Nothing in this clause deprives a person of protections or court access which cannot lawfully be excluded under otherwise applicable mandatory law.

Changes to these Terms

We may update these Terms and show the date of the revision. For material changes to contractual rights affecting restricted users, we will give reasonable notice and seek fresh acceptance where required by law or the nature of the change. Publication alone does not override an existing signed agreement.
